The Litigation Bureau meets the challenges faced by Westchester County in an ever-evolving legal environment. As the defenders of the County and its officers and employees, the bureau’s attorneys handle a myriad of civil actions and special administrative proceedings, excluding those managed by the Family Court Bureau.

Litigation Bureau Expertise:

General Litigation:

In the realm of general litigation, this Bureau defends the County in civil actions in both State and Federal courts. From breach of contract cases to challenges against local laws, federal and state claims, environmental reviews and employment claims by County employees, the Law Department navigates the various legal issues confronting the government of Westchester County.  The bureau also initiates litigation on behalf of the County, such as challenges to regulations or decisions of New York State affecting the County. The Bureau also handles administrative proceedings such as employee disciplinary hearings as well as grievance arbitration hearings.

Tort and Public Official Liability:

Defending the County in approximately 500 tort actions annually, the Litigation Bureau litigates personal injury or property damage cases arising from acts or omissions of County officers or employees within the scope of their employment. The Bureau’s work covers a range of scenarios, including alleged dangerous conditions on County property, automobile accidents involving County vehicles and more.

Civil Rights Claims:

With regard to civil rights, the Litigation Bureau defends the County against actions challenging its policies or practices in federal and state court. This complex litigation involves constitutional questions, including discrimination, sexual harassment, the first amendment and due process of law. The Law Department also defend these claims in the New York State Division of Human Rights and the Federal Equal Employment Opportunity Commission.
