On June 23, 1998, a new
Petroleum Bulk Storage Code
went into effect in Westchester County. The Department of Health
received delegation of authority from the New York State Department of
Environmental Conservation to implement and enforce this code.
Under the Petroleum Bulk
Storage Code, the Department of Health is responsible for registering,
monitoring, testing, and, where necessary, requiring remediation of code
violations for all petroleum bulk storage tanks in Westchester County once
the aggregate amount exceeds 1,100 gallons within a property.
Violations of the code can result in fines of up to $1,000 per day.
There are over 3,000
facilities in the county which own and operate petroleum bulk storage
tanks and approximately 7,500 tanks fall under code. Tanks affected
by the code are found mainly in commercial facilities, gas stations, and
in some instances, large apartment buildings.
A three month moratorium on
code enforcement activities was held, during which the Department of
Health conducted educational activities directed at those affected by the
code. The Department of Health conducted training seminars for
owners and operators of petroleum bulk storage tanks in northern, southern
and central tiers of the County. A direct mailing campaign was also
launched to inform all regulated facilities about the requirements of the
law.
