What should I do if I obtain an eviction notice?
When a lease is in place, a landlord must give a written 30-day eviction notice and begin court proceedings. A court date will be assigned and the tenant must appear and present his/her side of the story. The judge may uphold or deny the eviction or may grant the tenant an additional 30, 60 or 90 days to find alternative housing. Without a lease, a landlord is only required to issue a 30-day written notice. Court proceedings are not required. Tenants receiving an eviction notice can contact Westchester-Putnam Legal Services at (914) 949-1305 and (914) 376-3757. The Westchester County Bar Association's Lawyer Referral Service at (914) 761-5151 can provide callers with the name and phone number of an attorney specializing in the area of need. There is a nominal fee for the initial consultation. Should the client opt to retain the attorney, the parties would agree upon future legal fees.

How do I sue the County? How do I serve papers upon the County? How and where do I file a notice of claim against the County?
The Westchester County Attorney’s Office is authorized by law to represent the interests of the County of Westchester and, under some circumstances, the County’s officers and employees. Therefore, it would be inappropriate for the Westchester County Attorney’s Office to provide information which would facilitate an individual to sue the County. No person would want or expect his or her own attorney to inform an adversary regarding such matters. Nevertheless, if you wish to know the answer to these questions, you should contact an attorney as necessary to ensure that your own rights are preserved. In addition, if you wish to represent yourself, additional information is available on the Law Department FAQ page below.
