ARTICLE XXIV

 RESTRICTIONS ON THE SALE OF OVER–THE-COUNTER PRODUCTS CONTAINING
 PSEUDOEPHEDRINE OR PHENYLPROPANOLAMINE WITHIN THE COUNTY OF WESTCHESTER

863.1010.                Retail or over-the-Counter Sale of Products Containing Pseudoephedrine or Phenylpropanolamine.

No person or merchant shall sell or cause to be sold more than nine (9) grams of a drug or product containing as an active ingredient pseudoephedrine, phenylpropanolamine, or any of their salts, optical isomers, or salts of optical isomers or combination thereof in a single over-the-counter sale or transaction in Westchester County. This section shall not apply to any compounds, mixtures or preparations which are in liquid, liquid capsule, or gel capsule form if either pseudoephedrine or phenylpropanolamine are not the only active ingredients.

As used herein, the term “over-the-counter sale or transaction” shall mean a retail sale of a drug or product other than a drug or product which is dispensed upon the prescription of a physician or other person legally authorized to issue such prescription. “Over-the-counter sale or transaction” sale not include the retail sale of a drug or product to a licensed physician, pharmacist, or hospital.

863.1011.         Enforcement and Penalties.

For the first violation of the provisions of this Article, a notice of violation shall be issued to the offending party. For the second violation, a civil penalty not exceeding five hundred dollars ($500.00) shall be imposed. For the third and succeeding violations, a civil penalty not exceeding one thousand dollars ($1000.00) shall be imposed for each single violation. No civil penalty shall be imposed as provided for herein unless the alleged violator has received notice of the charge against him or her and has an opportunity to be heard.

 

863.1012.                Reverse Preemption.

This chapter shall be null and void on the day that Federal or Statewide legislation goes into effect, incorporating either the same or substantially similar provisions as are contained in this law, or in the event that a pertinent state or federal administrative agency issues and promulgates regulations preempting such action by the County of Westchester. The County Legislature may determine via mere resolution whether or not identical or substantially similar federal or state legislation, or pertinent preempting state or federal regulations have been enacted for the purposes of triggering the provisions of this section.

 

863.1013.        Separability.

If any section, subsection, sentence, clause, phrase or portion of this local law for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.

        Section 2. This local law shall take effect (90) days after its enactment.
